On June 9, 2012 at approximately 1:41 am, deputies from the Clackamas County Sheriff's Office responded to a motor vehicle crash at 8814 SW Kalyca St. in the city of Wilsonville, Oregon.

911 callers reported a Ford truck had crashed into a house and the driver was trying to flea the scene with the vehicle. Prior to the arrival of the deputies the suspect did leave the scene with the vehicle.

The house had what appeared to be some structural damage. No one inside the house was injured. There were four residents asleep inside, two adults and two children. The first 911 caller was Joevanny Garcia, a 16 year-old resident of the house. He called as his father went outside to find out what happened.

The Ford truck was located eight houses away on an adjacent street in the driveway of 31269 SW Chia Lp Wilsonville, OR. The truck had damage consistent with the collision. Deputies knocked on the door and asked to speak with the registered owner of the vehicle, Nicholas Butler, 40. When Butler came out of the house he was agitated and aggressive towards the deputies. Butler appeared to be intoxicated so the deputies began a DUII investigation.

Butler was not being cooperative with their investigation. When deputies made the decision place Butler in custody he resisted and began to fight with them. There were three deputies on scene at the time. The deputies were able to subdue Butler's resistance and took him into custody.

During the struggle Butler was injured. Butler was taken to OHSU and treated for a small laceration to his head before he was cleared by a doctor to be booked at the jail. Two of the three deputies had minor injuries that did not require medical attention.

Butler's blood alcohol content was determined to be .135%. Butler was booked at the Clackamas County Jail for driving under the influence of intoxicants, assaulting a public safety officer, resisting arrest and failing to perform the duties of a driver.
