UPDATE: LANE COUNTY DISTRICT ATTORNEY ANNOUNCES OSP TROOPER-INVOLVED USE OF DEADLY FORCE JUSTIFIED

On September 21, 2010, Lane County District Attorney Alex Gardner held a news conference related to the investigation into Saturday night's non-fatal officer-involved shooting in Oakridge.
District Attorney Gardner announced that after a review of witness statements, video evidence, and other evidence developed during the course of the investigation led by the Lane County Sheriff's Office, the shooting of James Patrick Powers by Oregon State Police Trooper Caleb Ratliff was "justified and consistent with the requirements of Oregon law."
On September 18, 2010 at approximately 9:30 p.m., Trooper Ratliff and Oakridge Police Officer Zachariah Ames responded to a report of a subject matching the description of a wanted armed and dangerous fugitive (Powers) walking toward the east side Oakridge city limits when they spotted the man in the 48000 block of East 1st Street. As the two officers attempted to make contact with the man, he pulled out a handgun and was shot by Ratliff.
James Patrick Powers, age 47, was transported by ambulance to an area hospital where he is still being treated for non-life threatening injury. Information released during the news conference incidated Powers was shot three times. Officer Ames did not fire his weapon during the encounter.
