MILWAUKIE DETECTIVES ARREST MAN FOR FRAUD, DISCOVER MARIJUANA GROW IN HOME; THREE-YEAR-OLD CHILD TAKEN INTO PROTECTIVE CUSTODY

Detectives from the Milwaukie Police Department were investigating 25-year-old Justin Jensen (DOB 12-17-85) for the crime of Fraudulent Use of a Credit Card. Jensen allegedly defrauded his girlfriend's mother of over $4900 by using the victim's credit card without permission. Jensen made cash withdrawals from the victim's account between December of 2009 and March of 2010, while he was living with his girlfriend and her mother in the 4200 block of SE Jefferson Street in Milwaukie.
Justin Jensen recently moved into a trailer located in the 1100 block of SE 82nd Drive in Clackamas County. He lives there with his three-year-old son, and his girlfriend, Lisa Everett. On 06-17-10, Detectives contacted Jensen at his residence and arrested him on felony charges of Fraudulent Use of a Credit Card and Theft I. (The girlfriend was not at the home.)
During contact with Mr. Jensen, detectives smelled a strong odor of marijuana from inside the residence. Detectives discovered a marijuana grow operation inside the trailer. Detectives seized 11 mature marijuana plants from the residence. Detectives were concerned for the welfare of the three-year-old child. The child had access to the grow materials, which included fresh and processed marijuana. Also accessible to the child was drug paraphernalia and a variety of power tools and other sharp instruments within the child's reach.
Mr. Jensen was booked on charges of Manufacturing a Controlled Substance, Fraudulent Use of a Credit Card, and Theft I. Additional criminal charges pending include Criminal Mistreatment in the First Degree, and Possession of a Controlled Substance.
Police notified Department of Human Services. DHS responded and is conducting an investigation into the living conditions for the three-year-old child. DHS placed the child in the care of relatives while the incident is being investigated.
Criminal Mistreatment 1 (Oregon Revised Statute 163.205) is defined as:
A person commits the crime of criminal mistreatment in the first degree if:
(b) The person, in violation of a legal duty to provide care for another person…..intentionally, or knowingly, (C) leaves the dependent person….unattended at a place for such as period of time as may be likely to endanger the health or welfare of that person.
Criminal Mistreatment in the First Degree is a class C Felony.
